  • F&H Solutions Group (FHSG) was hired by a multinational hi-tech government contractor to review FLSA and compensation issues. This involved employees in several states, including California, plus international issues involving travel time and work shifting. We identified the risks and assisted the client in implementing preventive changes without incurring a Department of Labor (DOL) investigation or lawsuit. Our work involved distinctions in state laws, FLSA coverage issues, federal contracts and Department of State requirements.
  • FHSG was hired to assist a national restaurant chain to review FLSA/compensation issues involving unit management and drivers. Following the 2004 changes in the "white collar" exemptions, many restaurants were found to be noncompliant with respect to those in management or assistant management positions. Our client was brought into compliance with no investigation or lawsuit.
  • FHSG was retained by an International company to review exemptions for "computer professionals" and other white collar exemptions following the 2004 regulation change. Many software companies had been sued regarding this exemption, resulting in millions of dollars in settlements. Our client has neither been sued nor investigated by DOL on this issue.
  • FHSG was hired by an International marine expedition company to review FLSA/compensation issues for white-collar exemptions and seafaring issues. The work involved determining coverage, “Jones Act” considerations, international travel, and evaluation of technical duties. As a result of our work, the client has had no investigations or lawsuits.
  • FHSG was retained by a national multi-line insurance company to review white-collar exemptions and pay practices for a regional office and individual broker offices.
  • FHSG consultants have also provided litigation support for FLSA collective actions and individual suits, managed numerous DOL investigations, and have experience in FLSA/compensation reviews in many industries including financial services, medical facilities, nursing homes, municipalities, trucking/transportation, employee leasing, retail, and hospitality. These projects involved issues of exemption, overtime, recordkeeping, compensability of hours worked, travel/training/waiting time.
