With a Presidential Election four months away and many opinions being generated about politics, wearing masks, and the BLM movement, it may be a great time for employers to once again review their social media policies. Employers should include in their handbooks a social media policy that establishes rules and guidelines for communicating information relating to the company via social media. In drafting a social media policy, you should consider the following:
- Define social media broadly.
- Reiterate that company policies apply to online conduct.
- Address work usage.
- Protect intellectual property and proprietary and confidential information.
- Distance company from the employee.
- Consider FTC guidelines regarding endorsements.
- Consider employees’ privacy rights.
- Consider employees’ NLRA section 7 rights.
