When an employee invokes their Weingarten Rights, supervisors should understand their roles. Here are three reminders for supervisors:
- Employees have Weingarten rights during investigatory interviews – this occurs when a supervisor questions an employee to obtain info that could be used as a basis for discipline or asks an employee to defend their conduct
- Management is not required to inform the employee of their Weingarten rights
- Management has three options if an employee asks for a union rep to be present:
- Stop questioning until the representative arrives
- Call off interview
- Tell the employee that it will call off the interview unless the employee gives up rights to a union representative
