While the Department of Justice and the Equal Employment Opportunity Commission are in disagreement about how to approach the issue of gender identity in the workplace, California has taken steps to clarify its position by successfully signing Senate Bill 396 into effect.
The bill is one of the first of its kind in the country—it extends protective rights to those employees who may face harassment based on their gender expression, sexual orientation, or gender identity. These changes must be reflected in the pre-existing mandatory two-hour harassment training sessions that have been required since the passing of California Assembly Bill 1825 in 2005.
